These terms and conditions (the “Terms and Conditions”), including the Privacy Policy and other documents referred to in these terms and conditions (the “Agreement”) is a legal agreement between you (hereinafter, “you” or “your”) and Preston Educational Consultants, hereinafter referred to as gofrance (“GOFRANCE”), respecting your use of the Services as described herein.
By indicating your acceptance by clicking on the appropriate button when signing up for the services, or by otherwise using the services, you are agreeing to be bound by the terms of this agreement.
By accepting this terms and conditions agreement, you hereby authorise gofrance to contact you via mobile calls, SMS, WhatsApp, email and any other mediums of communications. You also agree that this will override your registry on the National Customer Preference Register (NCPR), formerly the National Do Not Call Registry (NDNC) at any given point of time. Your acceptance of these Terms & Conditions and Privacy Policy gets auto renewed every three months. These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through partners) made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the "website") and/or by submitting a call back request, you acknowledge and agree to have read, understood and agreed to the Terms & Conditions set out below (including the Privacy Policy).
Scope of Our Services :
Through the website (www.gofrance.com), gofrance and its partners provide an online platform through which schools will be listed, and through which visitors to the website can request for gofrance service to help them apply. By making an application through gofrance, you don’t enter into a direct (legally binding) contractual relationship with the schools at which you apply. From the point at which you make your application, we act solely as an intermediary between you and the schools, transmitting the details of your application to the relevant school. gofrance is a representative of the Schools that are displayed on the gofrance platform. When rendering our services, the information that we disclose is based on the information provided to us by school websites. Although we will use reasonable skill and care in performing our services we will not verify if, and cannot guarantee that all information is accurate, complete or correct, nor can we be held responsible for any errors, any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Our website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any school made available. Our services are made available for personal and non-commercial use only. Therefore, you are not allowed to resell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, products or services available on our website for any commercial or competitive activity or purpose.
Cost/Prices/Fees :
All prices on the gofrance website are calculated per person per year, unless stated differently on our website or email. Sometimes lower prices are available for a specific program at a school, however, these prices made by schools may carry special restrictions and conditions. The currency converted is for information purposes only and should not be relied upon as accurate and real time; actual rates may vary. Obvious errors and mistakes (including misprints) are not binding.
GoFrance Service Fees :
Our service is free except for the application fee that students need to pay to apply for school. The application fee is a non-refundable fee that is charged when submitting applications. Schools pay a commission (being a small percentage of the tuition price) to gofrance when the student has confirmed enrolment with the school. Schools may also pay gofrance for other marketing opportunities such as newsletters and sponsored content.
Disclaimer :
To the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, partner companies, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including prices, availability and ratings) of the school as made available on our website, (iii) the services rendered or the products offered by the school or other business partners, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the school or any of our other business partners (including any of their employees, directors, officers, agents, representatives or partners companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the website, including any (partial) cancellation, strike, force majeure or any other event beyond our control. Whether the school you enrol with charges you or has charged you, or we are facilitating the payment of the school fees, you agree and acknowledge that the school is at all times responsible for the collection, withholding, remittance and payment of the applicable taxes due on the total amount of the school fees to the relevant tax authorities. gofrance is not liable or responsible for the remittance, collection, withholding or payment of the relevant taxes due on the school fees to the relevant tax authorities.
Licence :
By submitting content such as text or photos/images to gofrance (for instance in addition to a review or personal account) you certify, warrant and agree that you own the copyright to the content and that you agree that gofrance may use the submitted content on its website and app, and in (online/offline) promotional materials and publications and as gofrance at its discretion sees fit. You are granting gofrance a non-exclusive, worldwide, unconditional, perpetual right and licence to use, reproduce, display, have reproduced, distribute, sublicense, communicate and make available the content as gofrance at its discretion sees fit. By submitting this content, the person submitting the content accepts full legal and moral responsibility of any and all legal claims that are made by any third parties (including, but not limited to, school owners) due to gofrance publishing and using this content. gofrance does not own or endorse the content that is submitted. The truthfulness, validity and right to use of all content is assumed by the person who submitted the content, and is not the responsibility of gofrance. gofrance disclaims all responsibility and liability for the content posted. The person who submitted the content warrants that the content shall not contain any viruses, Trojan horses or infected files and shall not contain any pornographic, illegal, obscene, insulting, objectionable or inappropriate material and does not infringe any third party (intellectual property right, copyright or privacy) rights. Any content that does not meet the aforesaid criteria will not be posted and/or can be removed/deleted by gofrance at any time and without prior notice.
Intellectual Property Rights :
Unless stated otherwise, the software required for our services or available at or used by our website and the intellectual property rights (including copyrights) of the contents and information of and material on our website are owned by gofrance, its suppliers or providers. gofrance exclusively retains ownership of all rights, title and interest in and to (all intellectual property rights of) (the look and feel (including infrastructure) of) the website on which the service is made available (including the reviews and translated content) and you are not entitled to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilise, combine or otherwise use the content (including any translations thereof and the reviews) or our brand without our express written permission. To the extent that you would (wholly or partly) use or combine our (translated) content (including reviews) or would otherwise own any intellectual property rights in the website or any (translated) content or reviews, you hereby assign, transfer and set over all such intellectual property rights to gofrance. Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our intellectual property rights (including copyright and database right).

Although the Website and Services may link to other resources (such as websites, mobile applications, etc.), we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically stated herein. Some of the links on the Website may be "affiliate links". This means if you click on the link and purchase an item, the Operator will receive an affiliate commission. We are not responsible for examining or evaluating, and we do not warrant the offerings of any businesses or individuals or the content of their resources. We do not assume any responsibility or liability for the actions, products, services, and content of any other third parties. You should carefully review the legal statements and other conditions of use of any resource which you access through a link on the Website and Services. Indemnification :
You agree to indemnify and hold gofrance and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys' fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website and Services or any wilful misconduct on your part.
Severability :
All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.
Dispute resolution :
The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Tamil Nadu, India without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of India. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Tamil Nadu, India, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.
Changes and Amendments :
We reserve the right to modify this Agreement or its terms relating to the Website and Services at any time, effective upon posting of an updated version of this Agreement on the Website. When we do, we will revise the updated date at the bottom of this page. Continued use of the Website and Services after any such changes shall constitute your consent to such changes.
Acceptance of these terms :
You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Website and Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorised to access or use the Website and Services.
